In these terms, "we" and "us" mean 3DGS Orbit Studio. "You" means the client who accepts a quote or places an order.
Scope
These terms apply to every offer, quote, order and assignment between us, unless we have agreed something different in writing. Your own purchasing terms do not apply, even if we do not object to them explicitly.
If any part of these terms turns out to be invalid, the rest stays in force and we replace the invalid part with something as close to it as the law allows.
Quotes and prices
Prices start at €99. The final price depends on the property: the size of the plot, how much of the exterior needs covering, and how complex the site is to fly and process.
We offer two payment models. Which one applies is stated in your quote:
- One-off fee. A fixed amount agreed before we start, invoiced after delivery of the finished scan.
- Percentage of the sale. Between 0.1% and 0.25% of the property's sale value, invoiced once the sale has completed at the notary.
Quotes are valid for 30 days unless stated otherwise. All prices are exclusive of BTW. Prices may change for future assignments and during promotional periods; the price in your accepted quote is the one that applies to that assignment.
Booking and access
You send us an address and a time window. We check the airspace and confirm a slot. By booking, you confirm that:
- you own the property or have the owner's permission for us to scan it;
- we can access the site and the area immediately around it at the agreed time;
- you have told us about anything on site that affects safety or access, such as construction work, animals or restricted areas.
If we arrive and cannot carry out the scan for a reason on your side, we may charge the call-out costs and reschedule.
Flying and weather
Drone flights are subject to Dutch and EU drone rules and to local airspace restrictions. We fly only where and when it is legal and safe to do so.
Rain, strong wind, poor light or a late airspace restriction can make a flight impossible. If that happens we reschedule to the next suitable slot at no extra charge. We are not liable for costs you incur because a scan had to be moved.
Delivery
We aim to deliver the finished viewer within one week of the scan. This is a target, not a hard deadline, unless we have agreed a fixed delivery date in writing.
Delivery consists of a hosted 3D viewer and an embed link or embed code you can place on your listing page. We host the viewer; you place it.
If part of the exterior could not be captured for legal, safety or physical reasons, we tell you before delivery and, where relevant, adjust the price.
Licence and ownership
We keep the intellectual property in the raw footage, the trained 3D model and the viewer software.
On full payment you receive a non-exclusive licence to use and embed the delivered viewer for marketing the property in question, for as long as the listing is live and for a reasonable period afterwards. You may share the link, embed it on portals and use stills from the viewer in your own marketing for that property.
You may not resell the scan, pass it to a third party as their own work, or attempt to extract, copy or re-host the underlying model without our written permission.
Unless you tell us otherwise in writing, we may use anonymised stills or clips from the scan in our own portfolio and marketing.
Payment
Invoices are payable within 14 days of the invoice date, unless the quote says otherwise.
- For a one-off fee, we invoice after delivery.
- For a percentage of the sale, we invoice after the sale has completed. You tell us when completion has taken place and the sale value on which the percentage is calculated.
If an invoice is not paid on time, statutory commercial interest and reasonable collection costs may be charged in line with Dutch law. We may also suspend or take down a hosted viewer while an invoice is overdue.
Cancellation
You can cancel or move a booked scan free of charge up to 24 hours before the agreed slot. Within 24 hours we may charge up to 50% of the agreed fee, or the full call-out cost if we are already on our way.
Once processing of the scan has started, the assignment cannot be cancelled free of charge.
If you are a consumer rather than a business, you may have a statutory 14-day right of withdrawal. Where you ask us to start the work inside that period, you accept that the right of withdrawal ends once the work is complete.
Privacy on site
A scan of a property exterior can incidentally capture neighbouring buildings, vehicles or people. We take reasonable care to limit this and we blur or remove faces, number plates and other identifying details on request.

Liability
We carry out each assignment to the best of our ability. Our liability for any damage arising from an assignment is limited to the amount invoiced for that assignment, or, where insurance pays out, to the amount actually paid out by our insurer.
We are not liable for indirect or consequential loss, including lost sales, missed viewings, reputational damage or loss of data.
These limits do not apply where the damage results from intent or deliberate recklessness on our part, or where the law does not permit them.
Complaints
If something is wrong with the delivered scan, tell us within 14 days of delivery at James@orbitstudio.nl, describing the problem. We will respond within 14 days and, where the complaint is justified, repair, redo or credit the work.
Governing law
Dutch law applies to these terms and to every assignment between us. Disputes we cannot resolve together are submitted to the competent court in the district of Zeeland-West-Brabant, unless the law requires a different court.
We may update these terms. The version that applies to an assignment is the one published when the quote was accepted.
